        Conference to Address Guardianship Proposes that We Stay Inside the System – Activist Post

        On February 1, 2023, the Third Annual Conservatorship and Guardianship Abuse Conference took place online. The conference featured a number of speakers, and the message that came through was stunningly cohesive — “The system is a mess.”

        Advance billing for the conference promised that solutions would be presented. However, most of the presenters focused on the fact that the system put in place to ostensibly protect the elderly and disabled had turned into an abuser’s wet dream.

        From my perch in Latin America, it seemed to me that the presenters were top heavy in both damning and also exonerating a system which both robs the elderly of their rights and their assets and in many cases, also attacks those who might try to defend their loved ones. The schizophrenia of both decrying and then affirming the system in place did not escape notice.

        The decrying came from attorney Lisa MacCarley and also attorney and gerontologist Susan Geffen. “If at all possible, stay out of probate court,” advised Geffen, while MacCarley took the tack of trying to excuse the judges for their horrific decisions by stating “They are overworked and incompetent.”

        The solutions presented were clearly in line with keeping within the corral, so to speak. A former LEO, William Lightfoot, advised us to keep the pressure on recalcitrant police agencies, which usually dismiss elder abuses under guardianship as “civil matters.” Lightfoot advised that the classification needed to be changed and criminal charges needed to be launched against elder abusers. His solution? “Keep calling the police,” he advised.

        Kerri Kasem, whose famous father Casey went under a much-publicized guardianship, advised us to “keep calling your state representatives.” KK apparently believes that new laws are the answer. She started a campaign a number of years back to pass visitation laws (so that you can actually visit your guardianized loved one) and successfully got visitation laws passed in twenty-five states. The fact that laws protecting those under guardianship are generally ignored by both judges and by law enforcement, a fact promoted by the prior presenter, Mr. Lightfoot, did not figure into her impassioned speech.

        “The system has been designed to serve the most nefarious parties,” stated presenter Rick Black, who is head of CEAR. He then lets us know who those parties are — what he terms “predator attorneys.” Black does a complete detour around the fact that these attorneys are aided by the State, in the persons of delinquent judges and lackadaisical police and prosecutors. In fact, the entire conference seemed to be tilted towards exonerating the State in every manner possible. “I don’t call people out for being criminal,” stated attorney MacCarley. “The judges are simply incompetent.”

        “The key to everything is holding the judges accountable,” says Gettinger. The former police officer knows personally the power of a vengeful judge. Gettinger was arrested by a swat team in the middle of the night for posting on line “negative” comments about a judge. He was held in Pasadena jail for several days, but never charged.

        Says Gettinger, “Judges need to face prosecution for their crimes against litigants.” Gettinger has been part of a team promoting Richard Fine’s Judicial Corruption bill.

        From my perspective, things seem pretty clear. As long as judges are literally getting away with theft and worse, and as long as they are receiving monies under the table for this twisted service to the State, things aren’t going to change. And conferences, well intentioned as they may be, which urge us to stay inside the system end up keeping us married to a duplicitous and harmful reality.
